Code officer finds evidence supporting Glidden Point Oyster operation
A lengthy search of decades-old municipal documents has shown, Glidden Point Oyster Farm is in compliance with all town ordinances except one. April 16, Code Enforcement Officer Marian Anderson reported her findings dating back 10 years regarding River Road, LLC, Glidden Point Oyster Farm Co. and Ryan McPherson, who is the owner. "By going through all the site plans from 2016 to present, and in consultation with the town attorney, I found that the 2018 site plan allowed for food and beverage service, aquaculture and associated outdoor dining and parking," she said.
In recent years, River Road neighbors of Glidden Point Oyster Farm claimed the business was operating beyond municipal ordinance constraints. Anderson said the property had 20 parking spots previously approved in its site plans, and the property is allowed to host weddings as long as "it's an incidental use."
Another past neighbor complaint centered around food trucks. Anderson reported the 2018 site plan included food trucks. "The food truck is permitted in accordance with the approval of food and beverages and outdoor dining on the site, as long as the truck has all of its licenses. I checked last year, and, all the licenses were inside the trailer."
There was one citizen complaint for which Anderson didn't find no prior authorization. She said the property's two saunas weren't included in any previous site plans. She sent a letter to McPherson regarding her findings. She advised him to seek an amendment to his site plan if he intended to continue using the saunas. "If he doesn't then he risks being in violation. That's when we begin an enforcement," Anderson said.
Noise from weddings on the property has also been a source of neighbor complaints. Anderson found weddings were an approved use "as long as, it was an incidental property use." She reported the business hadn't advertised its location as a "wedding destination," so it met ordinance requirements.
In other action, the planning board conditionally approved a building permit for Joseph DiMauro's application for a single-family residence. DiMauro submitted plans to build a 1,700-foot home on his 3.2-acre Shore Road property. He needs to submit a map with "no less than 50-foot to one-inch scale" prior to gaining full approval.
The board meets next at 6:30 p.m. Thursday, May 7 in the conference room.
