BBHWP public hearing rescheduled

June 10, the Boothbay Harbor planning board rescheduled the public hearing for Boothbay Harbor Waterfront Preservation’s (BBHWP) East Side Park due to an issue on the board’s part with giving proper notice to the public.
May 13, the board deemed BBHWP’s amended site plan application complete on the condition BBHWP provide a copy of a 2020 letter from its consultant, Water Doctors of Maine, upon which its Natural Resources Protection Act approval was based. That condition was met. The new public hearing is at 6 p.m. July 8.
BBHWP attorney Anthony Muri raised timeline concerns, based on ordinances 170-66(A)(J), which says a public hearing must be held within 30 days of an application being deemed complete, and 170-66(A)(8), which says the board must give final approval or disapproval within 60 days of receiving a complete site plan review application, or within 30 days of a public hearing. Due to the rescheduling, the time to complete these steps while remaining in compliance with the ordinance is tight.
Town attorney Dan Stockford recommended the board try to complete business on July 8 and then vote on an extension, if needed.
In other business, the board unanimously determined Chuck and Jeanne Fuller’s site plan application and shoreland permit to operate Fuller Marine Construction at 85 Atlantic Ave. were complete. Chuck Fuller recently purchased the property and is going through the application and permitting process as the new owner, not because of property changes. He plans to submit another application to rebuild a pier.
The board also determined Boothbay Region Land Trust’s (BRLT) site plan application to add a gravel parking lot and garage at 60 Samoset Road is complete. In a post-meeting interview with the Register, BRLT Executive Director Nick Ullo said the lot will accommodate 53 parking spaces and the new 1,500-square-foot garage will replace a structure.
The public hearing for both applicants is at 6 p.m. July 2.
