Assault, threats and a getaway in Bristol

A Bristol man has been released on $5,000 bail after allegedly assaulting a family member and fleeing from police.

Lincoln County Sheriff's Office Deputy Ryan Chubbuck arrested Joseph Benner, 33, after the Bristol man allegedly went to a relative's house, assaulted a woman, made threats, smashed his car into hers, then fled from police on August 4.

Court documents allege that Benner had been drinking when he and his girlfriend arrived at a house in Bristol where a family member was living. Benner allegedly tackled the woman after an argument. As he was leaving, Benner reportedly smashed into the woman's car with his GMC Yukon before fleeing.

Chubbuck responded to the scene and had Deputy Jared Mitkus seek out the vehicle. Mitkus was able to eventually find the vehicle and begin a pursuit.

Speeds reached 80 miles per hour, but after a six mile chase, Benner was allegedly able to escape. Police would later find the vehicle and trace it back to Benner, and attempt to locate him with K-9 unit, but to no avail.

Benner was later found on Austin Street, allegedly asleep in another car in Bristol.

At one point, Benner is alleged to have called the family member he allegedly assaulted and made threats to her and other members of the family. The family member who had been assaulted was treated and released.

Benner was charged with two Class C crimes: aggravated criminal mischief for allegedly ramming the woman's car and eluding an officer. Class C crimes carry a maximum penalty of up to five years in prison and or a $5,000 fine.

Benner also picked up two Class D crimes for domestic violence assault and domestic violence threatening. Class D crimes are punishable by up to a year in jail.

As part of his release agreement, Benner is not allow to possess nor consume alcohol and his prohibited from making contact with the victims.
