A Waldoboro man who police say was drunk when he allegedly attempted an escape from custody was sentenced to three months in jail.

Billy Joe Perry, 41, of Waldoboro pleaded guilty to a lesser charge of refusing to submit to arrest on Monday, June 8 at the Lincoln County Court House. He was sentenced to 90 days in jail, with credit for 30 days already served.

Perry had a previous sentence in Kennebec County that included three years’ loss of license along with a $700 fine that the June 8 sentence will run concurrently with.

Perry was originally charged with class B escape, which is a felony, but that charge was dismissed as part of the plea deal and instead only pleaded to the class D charge of refusing to submit to arrest.

Perry was eventually indicted by the Lincoln County Grand Jury in 2015 on both the class B and class D crimes. Class B crimes are felonies and are punishable by up to 10 years in prison and up to a $20,000 fine while class D crimes are misdemeanors and are punishable by up to 364 days in jail and up to a $2,000 fine.

According to court documents, Perry was first taken into custody after Lincoln County Sgt. Brendan Kane responded to a report of a drunken man walking on the side of the road in Damariscotta in December 2014. When Kane approached Perry, he claimed Perry was heavily intoxicated.

At one point during the 2014 arrest, Perry was alleged to have told Kane he was on probation. When Kane spoke with the probation officer, they asked for an intoxicant test to be performed on Perry.

Perry was sent to Miles Memorial Hospital in Damariscotta, where he allegedly failed the test with a .25 blood alcohol content (BAC). While he was still at Miles, Perry “bolted” according to Kane's report, before being apprehended.
