Planning board uncertain about possible Shore Road house lot sale
The Edgecomb Planning Board advised a Massachusetts man to seek a legal opinion regarding his question about selling a two-acre house lot without access to the land. The board grappled with several possible scenarios regarding the sale before deciding the matter was too complicated to make a proper recommendation.
Jack French presented the request to the planning board during the June 16 meeting. French couldn’t remember the Massachusetts man’s name. He only knew that he wanted to sell the two-acre house lot with an operational septic system to a California man.
The property is located in the marine zone. The board found the matter complicated because the house lot is separated from the rest of the 22-acre property by a brook. There is no access to the house lot because the state Department of Environmental Protection prohibits building a bridge across the brook .
The board discussed various options before advising the landowner to seek a legal opinion.
“It’s a very complex issue because he only wants to sell two acres and there is no access to the property. We’d like to help, but the matter requires extensive research so we should tell him to get in touch with a lawyer,” French said.
In other action, the new municipal website — edgecomb.org — has been up and running for only a few weeks, but the planning board already wants to make changes. The board has concerns about wrong information being posted. The board submitted several proposed changes for the website committee to review. Selectmen’s Chairman Jack Sarmanian will review the recommended changes with the committee to make sure wrong information is replaced with the right language.
French said the committee properly posted the new land use ordinances approved at the May town meeting, but the appeals board information posted was inaccurate. French believes posting inaccurate information could lead to legal problems.
“If it’s not correct then it shouldn’t be on there. We need to take it down,” he said. “The last time we had inaccurate information on the website it cost us $10,000 in legal bills because the appeals process wasn’t properly listed.”
The board also reappointed French as chairman and Barry Hathorne as vice-chairman for a one-year term.
The board will meet next at 6:30 p.m. on Thursday, July 7 in the municipal building.
