Eastside Waterfront Park final briefs submitted to court
Boothbay Harbor Waterfront Preservation and park abutters Joe and Jill Doyle delivered their final round of briefs to Lincoln County Superior Court July 31 as part of the Eastside Waterfront Park dispute.
As reported in the Register, the court ordered both parties to present consolidated briefs on an ongoing conflict between the Doyles and BBHWP related to the construction of a park at 65 Atlantic Ave. in Boothbay Harbor. The conflict goes back to 2021, and first went to court June 15. This is the last of three rounds of legal briefs.
According to Kristin Collins, the Doyles’ attorney, this round is each plaintiff’s opportunity to rebut the arguments presented by the respective defendant. She said via email, the briefs are confined to issues already raised.
The case may not go to court as both parties expected. Collins said Justice Daniel Billings informed them he is unlikely to schedule a hearing and will likely decide the matter based on the briefs. She said the judge explained he usually does not call for hearings in such administrative appeals because all of the relevant information is in the record, and the attorneys have full opportunities to submit their arguments in writing.
