A Boothbay man who was arrested a year ago for allegedly stealing guns and a Nintendo has been rearrested for reportedly violating the conditions of his release.

Nicholas Hodgdon, 20, of Boothbay, was arrested Feb. 1 and charged with Class E violating the conditions of his release after he reported tested positive on a drug test.

Hodgdon was arrested by Lincoln County Sheriff’s Office Deputy Aaron Beck on Feb. 1 after Hodgdon reportedly tested positive for THC during a mandatory drug testing as part of previous bail conditions.

Hodgdon allegedly blamed the positive test on being close by when others were smoking marijuana. Hodgdon was arrested and charged with the misdemeanor count of violating the conditions of his release, to which he pleaded not guilty.

Hodgdon was originally arrested in August 2014 after he and another area 20-year-old allegedly broke into a neighbor’s home and stole a Nintendo Wii, handguns and a computer.

Beck reportedly received a tip shortly after the alleged August burglary and spoke with Hodgdon at a house on Wawenock Road in Edgecomb. While interviewing Hodgdon, Beck reportedly heard a crashing sound behind the house. When he investigated he found that someone had allegedly dropped the stolen goods from a window.

Hodgdon was charged with Class B theft and Class B burglary after the incident. Class B crimes carry a maximum sentence of 10 years in prison and up to $20,000 fine. Hodgdon was later indicted by the Lincoln County Grand Jury for one count of Class B burglary, two counts of Class B theft by unauthorized taking and one count of Class E theft.

Part of Hodgdon's bail conditions stipulated that he refrain from using or possessing illegal drugs. He was held on $200 cash bail and was ordered to neither use nor possess illegal drugs.

He will appear at Lincoln County District Court March 5.
