A Newcastle woman who pleaded not guilty to two counts, including burglary of a car, will have a trial Dec. 4.

Nichole Brackett, 29, of Newcastle, was arrested Sept. 26 in Damariscotta and charged with Class D burglary of a motor vehicle and Class E theft by unauthorized taking. During her Oct. 29 district court hearing, Brackett pleaded not guilty and will have a Dec. 4 court date.

Damariscotta Police Officer James Dotson was dispatched to the area near Elm Street after there was a report of a woman breaking into and going through cars. Dotson wrote in his arrest record that he stopped a woman who fit the description of the person going through cars.

At 2:50 p.m. on Sept. 26, Brackett was interviewed and after Dotson talked with witnesses he arrested her and charged her with burglary of a motor vehicle. According to the written report, witnesses claimed they saw a woman who matched Brackett's description accessing a Volvo and rummaging through the vehicle's back and front seats. It was also reported that the woman attempted to gain entry into several other vehicles.

Dotson wrote that he and Officer Jason Warlick allegedly saw Brackett attempting to access a vehicle when they pulled up, initially. Due to Brackett allegedly being intoxicated at the time of her arrest, she was restricted from using alcohol and was ordered not to return to that section of Elm Street.

If convicted, Brackett could face up to 364 days in jail and or up to a $2,000 fine for the Class D crime, and up to six months in jail and a $1,000 fine for the Class E crime. Both Class E crimes and Class D crimes are misdemeanors.
