Federal judge approves consent decree

    The legal battle between Boothbay and Coastal Maine Botanical Gardens is over. On April 25, U.S. District Court Judge Jon D. Levy approved a consent decree which settles two lawsuits CMBG filed against Boothbay.

    CMBG filed suits — one in federal, and the other in superior court – based on a Nov.9, 2017 board of appeals decision. The board voted 3-2 to deny a building permit for CMBG’s expansion project. On April 5, Levy heard arguments for and against the proposed settlement. CMBG and Boothbay attorneys supported the decree and the Anthony family’s lawyer argued against it. The Anthony family was named as an intervenor in the lawsuit and opposed the settlement.

    On March 28, Selectmen Chuck Cunningham, Steve Lewis, Dale Harmon and Mike Tomacelli supported the agreement. Selectman Kristina Ford voted against it.
