Barter Jr. charged with aggravated trafficking

    A Boothbay man on probation for multiple felonies was arrested and charged with aggravated trafficking after being arrested by the Lincoln County Sheriff’s Office and the Maine Department of Drug Enforcement.

    Leo Barter Jr., 43, of Boothbay was arrested April 29 after Lincoln County Sheriff’s officials allegedly observed him selling pills on two occasions.

    According to the arrest report, Barter was arrested April 29 after Lincoln County Sheriff Detective Jared Mitkus and Maine Drug Enforcement agent Jason Pease were conducting surveillance on Barter's house.

    According to the report, Barter was allegedly observed near the passenger side of another man's truck. Lincoln County Sheriff’s Sgt. Ronald Rollins and Mitkus followed the truck to Clifford Park, where the man allegedly threw something out of the window. The man told Mitkus that it was Oxycodone, and that he was about to use the drugs. The man also allegedly admitted that he had bought the drugs from Barter.

    When Mitkus returned to Barter's house, he allegedly observed him at the door of another man's car. According to the arrest report, Barter allegedly sold three milligrams of Oxycodone to the second man.

    Barter was arrested thereafter and charged with two counts of Class B unlawful trafficking in scheduled drugs and one count of Class E violating the conditions of release.

    According to probation officer Kevin Buckmore's report from November 2014, Barter was rearrested after a house visit.

    Barter pleaded guilty to Class C domestic violence in May 2013 and was sentenced to three years in prison with all but 30 days suspended, and two years of probation. Part of the probation included random searches and home visits.

    Barter was given a drug screen during the November 2014 visit, which he allegedly failed by testing positive for cocaine and Oxycodone. When Buckmore asked him about the positive test, Barter allegedly admitted to snorting the Oxy, but denied the cocaine; Barter allegedly blamed residue inside a straw for the positive test.

    Barter was arrested and transported to Two Bridges Regional Jail.

    Barter was also on bail conditions for a domestic violence assault charge, which he was scheduled for a June 8 court date.

    Following the April 29 arrest, Barter's probation was revoked.

    Barter has been to Two Bridges Regional Jail 17 times since 2008 for four counts of probation violation (including the April 29 charge), three times for violating the condition of his release, twice for domestic violence reckless conduct, twice for operating after suspension, once for domestic violence assault, one warrant for failure to pay a fine, once for a failure to report an accident, one theft by deception, one theft by unauthorized taking or transfer, once for carrying a concealed weapon and once for possession of a scheduled drug in addition to the two trafficking charges.

    If convicted, Barter could face maximum penalties of 10 years in prison and up to $20,000 in fines for each of the Class B crimes. He was held on $10,000 bail, and will have a court date at the Lincoln County Superior Court on June 22.
